One of the most common things we hear at Clear2Drive is:

“I just found out I need SR22 insurance. What even is it?”

Most drivers have never heard the term SR22 until after a DUI, license suspension, or serious driving violation. Then suddenly they are being told they cannot reinstate their license without it.

That confusion is understandable because SR22 insurance is one of the most misunderstood parts of the California reinstatement process.

The first thing drivers need to understand is this.

SR22 is not actually insurance.

An SR22 is a filing your insurance company submits to the California DMV proving that you carry the minimum liability coverage required by the state.

The SR22 itself is simply a certificate of financial responsibility tied to your insurance policy.

Why California Requires SR22 Insurance

How Long Do You Need SR22 Insurance in California?

In most California DUI-related cases, drivers are required to maintain SR22 coverage continuously for approximately three years.

The important word there is continuously.

If the policy lapses, cancels, or is terminated early, the insurance company is required to notify the DMV electronically.

That can trigger another suspension and create additional delays in restoring driving privileges.

We have seen many drivers get very close to completing their SR22 requirement only to have the clock effectively restart because of a lapse they did not realize happened.

What Happens If Your SR22 Insurance Lapses?

This is where many drivers run into serious trouble.

When an SR22 policy lapses, the insurance company files what is commonly referred to as an SR26 cancellation notice with the DMV.

Once that happens, the DMV may suspend the driver again until a new SR22 filing is submitted and processed.

Many drivers do not realize this can happen automatically.

  • a payment card expired
  • a bank account changed
  • the policy was canceled accidentally
  • the driver switched insurance companies incorrectly

Suddenly the driver learns their license is suspended again.

Another area that creates confusion is non-owner SR22 insurance.

Many drivers assume they cannot obtain an SR22 if they do not currently own a vehicle.

That is not true.
